Terms and Conditions (Beta)

Status: 5 October 2026

§ 1 Provider and scope

These terms apply to free beta use of CineStream, a platform for video review and approval workflows. The provider is BLRRD by Berkan Ustalar, Neumünster, Germany. Legal enquiries may be sent to berkan@blrrd.ai.

Different terms apply only where expressly agreed. Mandatory statutory consumer protection provisions take precedence for consumers.

§ 2 Subject matter and current scope

CineStream currently enables in particular the creation of projects and versions, the upload of review material, frame-accurate comments and approvals, and controlled invitations for reviewers. Current access is free and in beta.

Live and CineConnect are available in beta. Additional media functions and paid offerings are currently being developed or shown as “Coming soon”. Paid offerings are not part of current free access. Prices, capacities and payment terms become binding only with a separate offering.

§ 3 Registration and access

An account is required for protected functions. Information must be truthful and access data must be kept confidential. Users must notify us of unauthorised access and stop use where it would infringe third-party rights. Invitation links may be passed only to intended persons.

Minors may use CineStream only with the required consent of their legal representatives. Use on behalf of an organisation requires appropriate authority to represent it.

§ 4 Obligations regarding content and use

Users may upload, share or comment only on content for which they have the required rights. Prohibited content and conduct include unlawful content, copyright or personality-rights infringements, malware, abusive access, circumvention of access protection, and use that unreasonably impairs the service or other users.

Users remain responsible for their content and the lawfulness of their reviews. They indemnify BLRRD against justified third-party claims insofar as these arise from a breach for which they are responsible. Statutory rights and objections remain unaffected.

§ 5 Rights in user content

Rights in uploaded videos, comments, annotations and other content remain with the respective rights holders. To provide CineStream, users grant BLRRD a non-exclusive, geographically unrestricted right limited to the contract period to store, technically process and display that content to persons authorised by those users. Use for BLRRD’s own advertising purposes or transfer to third parties outside required technical operation is not included.

§ 6 Beta, availability and backup

The beta may contain errors, changes and interruptions. We seek reliable operation but do not owe a specific availability or service level. Maintenance and security measures may temporarily restrict use.

Users remain responsible for backing up important originals and working states separately. This recommendation does not limit statutory claims for breaches of duty for which BLRRD is responsible.

§ 7 Suspension and termination

Users may terminate their account at any time. Account deletion takes place through the account area; where an organisation is actively owned, transfer is required first if further members exist. BLRRD may temporarily suspend beta access for good cause, a legal breach or to avert a concrete danger. Permanent termination will be announced where reasonable.

After termination, the right of use ends. Statutory retention duties, legitimate evidence and technically required deletion runs remain unaffected.

§ 8 Intellectual property in the service

Software, design, trademarks and BLRRD content remain protected. Users receive only the non-transferable, non-sublicensable right required for contractual use. Reverse engineering and circumvention of technical protection measures are permitted only to the extent allowed by law.

§ 9 Liability

BLRRD is liable without limitation for intent and gross negligence, injury to life, body or health, under the Product Liability Act and for an expressly assumed guarantee. In the event of slight negligence in breach of essential contractual obligations, liability is limited to foreseeable, typical contractual damage. Otherwise, liability for slight negligence is excluded where legally permitted.

Mandatory statutory rights, in particular consumer rights relating to digital products and services, remain unaffected.

§ 10 Changes

We will inform you in good time about proposed changes to these terms. Contractual changes require your consent unless they apply directly by law. Silence or continued use alone does not constitute consent. Mandatory statutory rights remain unaffected.

§ 11 Law and jurisdiction

German law applies excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of mandatory protection under the law of their habitual residence. Statutory places of jurisdiction apply to consumers; jurisdiction for businesses is governed by statutory provisions.

§ 12 Contact and severability

Legal and privacy enquiries must be sent to berkan@blrrd.ai. Should any provision be or become invalid, the remaining provisions and statutory rules in their place remain effective.
